Ecuador fixes no number in statute: Código Civil art. 2110 delegates the legal rate to 'el organismo competente del Estado', and that rate is published monthly by the Banco Central del Ecuador as the Tasa de Interés Activa Legal (TAL). By the BCE's own methodology the TAL 'es igual a la tasa de interés activa efectiva referencial para el segmento productivo corporativo', and the Tasa de Interés Activa Máxima Convencional (TAMC) 'es igual a la tasa activa efectiva máxima del segmento productivo corporativo' — for August 2026 those are 6.79% and 7.86% respectively (Tasa Pasiva Referencial 5.10%). Amounts are in US dollars; Ecuador is dollarised. WHAT A CREDITOR CLAIMS ON A LATE MONEY DEBT: Código Civil art. 1575(1) — 'Se siguen debiendo los intereses convencionales, si se ha pactado un interés superior al legal, o empiezan a deberse los intereses legales, en el caso contrario', so the legal rate is the floor that starts running on mora only where no higher rate was agreed; art. 1575(2) removes any need to prove loss when only interest is claimed ('basta el hecho del retardo'); art. 1575(3) 'Los intereses atrasados no producen interés' and art. 2113 'Se prohíbe estipular intereses de intereses' — no compounding. CEILING AND PENALTY: art. 2109 defines the maximum conventional rate and the interés corriente, and expressly gives the Banco Central's Directorio power to set the mora rate applied from maturity; art. 2115 punishes a creditor who charges above the maximum with forfeiture of 20% of the credit to the IESS Seguro Social Campesino, even if the excess is dressed as a penalty clause. SEPARATE REGIME FOR REGULATED LENDERS: credit granted by supervised financial entities is priced within the Junta de Política y Regulación Financiera segment ceilings (Resoluciones JPRF-F-2021-004, 2022-031, 2022-053, 2023-070), and default there is charged as a graduated mora surcharge of up to 10% over the contractual rate on the overdue capital, not at the TAL.
