What this value means

Fixed 6% per annum since the Código Civil entered into force on 2 April 1976 — no reference rate, no periodic setter. Art. 414 is residual and runs only from the day of MORA (default), and only 'a falta del convencional': a rate validly agreed in writing displaces it. Art. 411 requires conventional interest to be stipulated in writing whatever the principal, failing which the legal rate applies; art. 409 caps conventional interest at 3% per month and automatically reduces any higher stipulation to that ceiling; art. 412 prohibits anatocismo (capitalisation of interest) outright and voids agreements to the contrary; art. 413 makes interest above the legal maximum, and capitalised interest, usura subject to restitution plus criminal sanction. COMMERCIAL DEBTS ARE NOT AT 6%: under Código de Comercio (Decreto Ley 14379 de 25 de febrero de 1977) art. 798, where a commercial transaction leaves the rate unstated the applicable rate is the current banking rate for the nature of the operation, and from maturity the banking default rate runs — both proved by certification from the competent supervisory authority (ASFI, Autoridad de Supervisión del Sistema Financiero). So a merchant creditor claims the ASFI-certified banking rate, not the 6% civil figure. Art. 410 defines interest broadly, capturing any surcharge, commission or excess over principal, so relabelled charges count against the 3% monthly ceiling.
